Caption Coach AI — Terms of Use

These Terms of Use (“Terms”) are a legal agreement between you and Sun Ventures (“we,” “us,” “our”) governing your use of the Caption Coach AI mobile application and any related services (collectively, “the App”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service. You may not copy, modify, reverse-engineer, decompile, redistribute, sublicense, sell, or create derivative works from the App, except as allowed by applicable law.

2. Eligibility

You must be at least 13 years old (or the age of digital consent in your country) to use the App. By using the App, you represent that you meet this requirement.

3. The service

Caption Coach AI generates social-media captions based on the voice samples, niche, and tone you provide, using third-party AI (Anthropic’s Claude API). Captions are generated by AI and may contain inaccuracies or content that does not suit your needs. You are responsible for reviewing, editing, and deciding whether to publish any caption. We do not guarantee the accuracy, originality, suitability, or results of any generated content.

4. Subscriptions — Caption Coach Pro

Caption Coach AI offers an auto-renewable subscription, Caption Coach Pro, which includes premium features. The following terms apply:

• Pricing: $6.99 USD per month or $39.99 USD per year. Prices may vary by region and are shown in the App at the time of purchase; the price displayed at purchase governs.
• Free trial: A 3-day free trial may be offered. If you do not cancel at least 24 hours before the trial ends, it automatically converts to a paid subscription and your payment method is charged. Any unused portion of a free trial is forfeited when you purchase a subscription.
• Payment: Payment is charged to your Apple ID account at confirmation of purchase.
• Auto-renewal: Your subscription automatically renews for the same period unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period, at the then-current price.
• Managing & cancelling: You can manage or cancel your subscription, and turn off auto-renewal, in your device’s Settings → Apple ID → Subscriptions (or the App Store account settings) at any time. Cancellation takes effect at the end of the current billing period.

5. Refunds

All purchases are processed by Apple. We are not able to issue refunds directly. Refund requests are handled by Apple in accordance with the Apple Media Services Terms and Conditions. You can request a refund through Apple at reportaproblem.apple.com.

6. Your content

You retain ownership of the text and materials you enter into the App (“Your Content”). You are solely responsible for Your Content and for any captions you choose to publish. You represent that you have the rights to the content you submit and that it does not violate any law or third-party right.

7. Acceptable use

You agree not to use the App to create, generate, or distribute content that is unlawful, infringing, harassing, hateful, deceptive, or that violates the rights of others, and not to misuse, overload, or attempt to gain unauthorized access to the App or its underlying services.

8. Third-party services

The App relies on third-party services to function, including Apple (distribution and payments), Anthropic (Claude API, for caption generation), and RevenueCat (subscription management). Your use of the App is also subject to their terms. See our Privacy Policy for how your data is handled.

9. Intellectual property

The App, including its design, code, branding, and content (excluding Your Content), is owned by Sun Ventures and protected by intellectual-property laws. These Terms do not grant you any rights in our trademarks or branding.

10. Disclaimer of warranties

The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that generated content will meet your expectations.

11. Limitation of liability

To the maximum extent permitted by law, Sun Ventures will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising out of or related to your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid us (if any) in the 12 months before the claim.

12. Termination

You may stop using the App at any time and delete it from your device. We may suspend or terminate your access if you violate these Terms. Sections that by their nature should survive termination (including ownership, disclaimers, and limitation of liability) will survive.

13. Apple App Store — additional terms

These Terms are between you and Sun Ventures only, not with Apple. You acknowledge that:

• Apple has no obligation to provide maintenance or support for the App.
• In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• Apple is not responsible for addressing any claims relating to the App, including product-liability, legal/regulatory non-compliance, or consumer-protection claims.
• Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party intellectual-property infringement claim relating to the App.
• You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you.

14. Governing law

These Terms are governed by the laws of the United States and the state in which Sun Ventures operates, without regard to conflict-of-laws principles, except where local consumer-protection law requires otherwise.

15. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above reflects the latest version. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
